Terms of Service

These terms apply to purchases and use of 8HP.Shop (the Site). 8HP.Shop is operated by MPerformance Parts Retail Pty Ltd (ABN 37 631 129 630) (we, us, our), business address 116/7 Hoyle Avenue, NSW 2154, Australia. By using the Site or placing an order, you agree to these terms.

1. About the products

1.1 8HP.Shop supplies specialist automotive, performance, conversion, used, imported, special-order and motorsport-related components, including ZF 8HP gearboxes, adapter kits, standalone controllers, shifters, cooling parts, internals and swap support.

1.2 Fitment can vary by engine, chassis, gearbox generation, controller, tune, wiring, transfer case and driveline setup. Product information is provided to help you choose parts, but final fitment and installation responsibility sits with you or your installer. Ask before ordering if you are unsure.

2. Pricing and availability

2.1 Prices, availability, lead times and product specifications can change without notice. All prices are in Australian dollars and include GST unless stated otherwise.

2.2 If an item becomes unavailable after you order, we will contact you with options, including a refund if the item cannot be supplied.

3. Orders and payment

3.1 Your order is an offer to purchase. We may accept or decline it. Payment is processed through the Site checkout and may include third-party payment providers.

3.2 We may cancel or refuse orders where there is an error in pricing, suspected fraud, or a legal or regulatory issue.

4. Delivery, title and risk

4.1 Dispatch timing and freight terms are set out in our Shipping Policy. Freight may be separately quoted for bulky items such as gearboxes.

4.2 Risk in the products passes to you on delivery to you or your nominated carrier. Legal title passes when we receive full payment.

5. Returns, refunds and warranty

5.1 Returns, refunds and warranty claims are governed by our Refund and Warranty Policy, which forms part of these terms. Read it before ordering.

5.2 Nothing in these terms excludes, restricts or modifies any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.

6. Product use and safety

6.1 Products should be installed by competent technicians. Motorsport and conversion use can increase the risk of wear, failure or incompatibility. Correct fluid, cooling, wiring, mounting and calibration are critical.

6.2 You are responsible for ensuring the product is suitable for your vehicle and intended use, including compliance with applicable road, registration, emissions and safety laws.

7. Intellectual property

7.1 The Site and its content, including text, graphics, logos, product images and software, are owned by or licensed to us. You may use them only for personal, non-commercial purposes in connection with the Site.

8. Limitation of liability

8.1 To the extent permitted by law, our liability to you in connection with the Site, products or services is limited to the amount you paid for the relevant products, or repair, replacement or resupply of the products, as we elect. We are not liable for indirect or consequential loss, including loss of profits, loss of use, damage to vehicles or third-party property, except where liability cannot be limited by law.

8.2 Nothing in this clause excludes liability that cannot be excluded under the Australian Consumer Law.

9. General

9.1 These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

9.2 If we need to resolve a dispute, we will first try to resolve it through our support channels (sales@8hp.shop). Nothing prevents either party from seeking urgent injunctive or other relief.

9.3 We may update these terms from time to time. The version on the Site at the time you place an order applies to that order.

9.4 If any part of these terms is unenforceable, the remainder continues to apply.
